Kellen Winslow Jr. was found in possession of a synthetic form of marijuana Nov. 19 by East Hanover, N.J., police, the Daily Record of Morris County reported Thursday.

The Jets tight end, who played several seasons with the Cleveland Browns, allegedly was found with the designer drug Fubinaca. A criminal complaint charging him with possession of the drug was not signed until Dec. 30, according to the report.

Winslow, 30, reportedly was charged with possession of a controlled dangerous substance, a third-degree offense punishable upon conviction by up to 5 years in prison. He was in Morristown Superior Court Wednesday with Colorado-based attorney David Blair for a central judicial processing hearing, where they were informed of the charges before a judge and given evidence against them.

A Jets spokesman issued this statement: "We are aware of the situation. This is a pending legal matter and we will have no comment."

The drug issue is not the only embarrassing issue that came to light recently for the University of Miami product. A publicist for Winslow issued a statement in response to a woman's claim to police that she saw the Jets tight end masturbating in his vehicle outside a Target in East Hanover back in November. On Oct. 11, Winslow was suspended four games for violating the NFL's performance-enhancing drug policy. His first game back was the Jets' loss to the Bills Nov. 17, two days before he allegedly was found in possession of synthetic marijuana.

Upon his return from suspension, Winslow said allergy medication may have been to blame for his failed drug test.

"That's the only thing I changed what I was taking, so that's what it had to be," said Winslow, who was the Jets' leading receiver before the four-game ban. "I'm not trying to go out and take illegal stuff. That's just not what I do."

Winslow, who lost $197,647 in salary, said he chose not to appeal so he could serve his suspension in the first half of the season rather than during a potential playoff push.

Winslow had 31 catches for 388 yards and two touchdowns in 12 games.

A first-round draft pick of the Cleveland Browns in 2004, Winslow is set to become an unrestricted free agent for the 2014 season.
